Terms and Conditions (Terms of Use)
SPICE SERVE Co., Ltd. (hereinafter referred to as "our company") promises the following matters regarding the "ANNIVERSARY CRUISE" service (hereinafter referred to as "this cruise service") related to the "Application Form" (hereinafter referred to as "Application Form") that you will sign and seal separately, and would like you to promise the same, so we present these terms and conditions (hereinafter referred to as "these terms and conditions").
Article 1 (Purpose of these Terms and Conditions)
The purpose of these terms and conditions is to define the rights and obligations between you and our company regarding our provision of the vessel necessary for this cruise service and other paid content at your request, and to set equality of interests, risks, etc. for both parties. Furthermore, we assume that the contents of these terms and conditions have been communicated to all accompanying persons other than the organizer, and that they understand and agree to them.
Article 2 (Provision of this Cruise)
- Click on a product category on the left side of the screen and the products in that category will be displayed on the right side.
- Click on the product you want to purchase and you will be taken to the product page where you can enter the quantity you want and add it to your cart.
- Click "View Cart" and then "Proceed to Checkout" to proceed to checkout.
Article 3 (Payment of fees and other procedures)
- We will receive your inquiry, hold a hearing, and then provide you with a quote. If an agreement is reached on the contract terms, we will ask you to sign and stamp the application form and terms and conditions.
- Regarding the payment of the deposit, after you have submitted the signed and stamped application form and these terms and conditions in paragraph 1, you must pay at least 30% of the estimated fare amount within seven days using the method specified by our company. The reservation will be confirmed at the time of payment. However, if the cruise date is approaching, we may require payment sooner rather than by this deadline. If you pay by bank transfer, please transfer the money to the account below. Bank transfer fees and other charges will be borne by the customer.

- With regard to the fees (or the remaining amount if a deposit has been paid), the Customer shall pay to us the estimated fee amount stated in the application form or the amount changed therefrom by agreement between the parties (or the remaining amount if a deposit has been paid) by the payment deadline or on the payment date stated in the application form using the payment method stated in the application form. Bank transfer fees and other costs required for payment shall be borne by the Customer.
- Unless otherwise agreed by our company, customers must confirm the number of passengers (and associated fees, etc.) and other service details at least four days before the cruise service begins.
Article 4 (Voluntary Termination by Customer)
- You may cancel this cruise service at your discretion before the service begins, but in that case you will be required to pay the following cancellation fees.

If you agree to the postponement, the fees you have already paid (deposit and remaining balance) will not be refunded, but will be retained and you will be charged an additional cancellation fee.
Article 5 (Change of payment deadline and voluntary cancellation by our company)
- Notwithstanding Article 3, Paragraph 4, due to issues with the contract with the ship management company or other circumstances, our company may be forced to request payment of all or part of the fee (or the remaining amount if a deposit has been paid) before the payment deadline or payment date, and if the customer refuses to pay, our company may modify or voluntarily terminate this contract, and the customer cannot object to this. Of course, in this case, if any fee (deposit) has already been paid, we will refund the full amount.
- If any of the following events occur to the Customer, the Company may terminate this Agreement at its discretion, and if the cancellation fee period set forth in Article 4 is still in effect, the prescribed cancellation fee will also be charged.①If it is discovered that the customer or the organization to which the customer belongs may be violating laws, regulations, public order, or morals.② If you fail to submit a copy of the representative applicant's identification, or if you otherwise violate this Agreement.
Article 6 (Flight cancellation, refunds available)
In order to ensure the safe operation of our vessels, we may cancel or suspend the operation of this cruise service if any of the following reasons apply. If a decision is made to cancel or suspend the service, we will promptly notify the representative and make every effort to minimize inconvenience to you. In this case, we will postpone the operation of the service or refund all or part of the fees already received.
- ①When weather or sea conditions make it extremely difficult to operate the vessel as scheduled, and when our company determines that there is a risk of danger to the operation and anchorage of the vessel, or to the implementation of the Service on another vessel, pier, or venue at sea or on land, or when a public institution makes a decision to suspend the operation of the vessel.
- ② In the event of a natural disaster, fire, maritime accident, breakdown of the vessel in use, or other unavoidable circumstances.
- 3) When ordered or requested by a government agency.
- ④ When leaving or arriving at the pier is dangerous due to congestion at the pier, a nearby ship accident, or other emergency.
- ⑤ When a vessel cannot be arranged, the number of passengers is exceeded, or it is otherwise extremely difficult to provide services as scheduled.
Article 7 (Flight Cancellation, No Refunds)
If any of the following events occur, your application will be cancelled and the flight will be suspended. If you cancel within the cancellation fee period, you will also be charged a cancellation fee.
Our company may cancel or suspend the operation of this cruise service if any of the following reasons apply. In such cases, we will not refund any fees already received, and if the full amount of the fee has not been paid at the time of cancellation or suspension, we will charge you for the remaining amount.
- ① If a major change to this Agreement is unavoidable due to customer circumstances
- ② If the customer or other passengers do not follow the captain or crew's instructions to avoid danger.
- ③ If the customer is a member of anti-social forces (meaning a member of an organized crime group, a right-wing organization, an anti-social force, or any other similar person), or if the customer has any interaction or involvement with anti-social forces, such as by cooperating with or being involved in the maintenance, operation, or management of anti-social forces through funding or other means.
- ④ If the customer or other passengers commit any of the prohibited acts set out in Article 9.
Article 8 (Changes, postponements, etc. of ships, departure and arrival times, departure and arrival locations, routes, etc.)
- If it becomes significantly difficult to operate as scheduled due to any of the reasons set out in Article 6, we may change the route or time, or use a different vessel or depart from a different departure or arrival location. In such cases, the departure or arrival location may change, and the departure or arrival time may be delayed. Please allow ample time for your cruise, inform all accompanying passengers, and ensure you have enough time after the scheduled cruise time to prepare for the departure or arrival time. If the departure or arrival location changes, you will be responsible for any transportation costs to the location.
- If departure becomes significantly difficult due to any of the reasons set forth in Article 6, we may consult with you and set a postponement date as soon as we become aware of the situation. However, if postponement makes it impossible to achieve the purpose of using this cruise service (if implementation under Paragraph 1 is also impossible), we will refund the full amount already paid within one week of the cancellation date. If holding the event on the same day is essential, and there is an option to hold it at a venue on land, we will propose and arrange the venue on your behalf to the extent possible (although we cannot guarantee that a venue on land will be secured).
- If the departure is in jeopardy due to an approaching typhoon or other weather conditions, we will generally make a decision by 8:00 PM the day before as to whether or not the departure can be carried out and contact you, but depending on the circumstances, we may decide to carry out the departure early in the morning on the day.
Article 9 (Prohibited acts by customers)
The following actions are prohibited for this cruise service. If a customer engages in any of these actions, our company will take appropriate measures, such as forcibly suspending the operation of the cruise, in accordance with this contract, laws and regulations, and the principle of good faith.
- ① Bringing in or using any flammable or combustible items, dangerous items, items that emit a foul odor, or items whose possession is illegal.
- ② Jumping into the sea in places other than those permitted, throwing objects into the sea, etc.
- 3) Violence, abusive language, or other conduct that may disturb the peace on board
- ④ Actions that may cause significant soiling or damage to onboard facilities
- ⑤ Obscene acts such as being drunk and completely naked
- ⑥ Any act that violates any law or regulation, or any other act that the Company deems inappropriate for a user
Article 10 (Points to note)
- To prevent disturbance to surrounding facilities, there is a limit on the volume of any equipment, whether it is our own or brought in, so please enjoy your cruise within the volume limits specified here. There is also a limit on the volume of sounds that can be heard inside and outside the ship due to engine noise, etc. Please note that we cannot be held responsible for any impact caused by engine noise.
- When traveling by train or car to the departure or arrival point, please be sure to arrive at the location with plenty of time to spare, as we cannot delay departure times due to traffic jams or schedule disruptions. Even if we depart late, we will return to port as scheduled. If the time is extended, additional fees may apply. However, depending on the pier and ship, we may be able to delay departure, re-dock at the pier, or stay moored at the pier to wait for latecomers if you inquire in advance, so please feel free to inquire.
- Please refrain from smoking and drinking if you are underage, and from drinking if you are driving. You may also be asked to show identification to verify your age.
- Our company will provide vessel operation, basic facilities (toilets, lighting, etc.), free operational support, paid content, etc. either directly or by appropriately outsourcing to third parties. However, please note that we cannot be held responsible for any mistakes in the services we provide free of charge, any malfunctions of incidental machinery and equipment that can be lent free of charge (microphones, audio-visual equipment, karaoke equipment, etc.), or malfunctions in the connection with various equipment brought by customers.
- If the onboard equipment or the vessel is damaged due to the customer's intentional or negligent actions, we may request payment of the actual costs and compensation for lost revenue opportunities due to the vessel being unable to operate.
Article 11 (Dispute Resolution Between Customers)
- We will not be held responsible for any accidents, thefts, or other disputes that occur between guests during this cruise service, unless the cause is attributable to our company. However, this does not apply if our company provides cloakroom services for a fee. Please be mindful of safety and valuables, and observe good manners and rules.
- We will not be held responsible for any accidents or other disputes that occur between you and our contractors or their officers and employees during the implementation of this cruise service, except for those caused by reasons attributable to our company. Please resolve the dispute with the contractor in question.
Article 12 (Cruising Services)
- As a general rule, we are not involved in the planning, progress, or results of wedding-related events, funerals, entertainment, corporate social gatherings, etc., held by our customers, and we will not bear any responsibility whatsoever except in cases where such occurrence is due to reasons attributable to our company.
- Please note that we cannot take any responsibility for free services provided to improve customer satisfaction (photography & gifts, audiovisual support, etc.).
- Please note that we will incur a separate service fee for wedding reception cruises due to our responsibility. If you choose not to pay the service fee, we will not be held responsible for any unforeseen circumstances that may occur during the cruise.
- BBQ is generally a format where customers grill the food themselves, but if you are tired or busy, or if you are short on time, we may provide support with preparation and cleanup.
Article 13 (Exclusion of anti-social forces)
Both the Company and the Customer represent and warrant to the other party that, from the date of this Agreement and in the future, they, or anyone using the Cruise Service at the same time as them, are not persons or organizations that fall under any of the following items (hereinafter referred to as "anti-social forces").
Organized crime groups, members of organized crime groups, associate members of organized crime groups, companies related to organized crime groups, corporate racketeers, etc., swindlers who pose as political or social activists, special intelligence violent groups, etc., and those who coexist with anti-social forces
If either the Company or the Customer determines, based on reasonable grounds, that the other party falls under any of the following items, the Company or the Customer may terminate this Agreement without any notice.
- ① If you are or were an anti-social force
- ② If you have committed any of the following acts against the other party yourself or through a third party:
- (a) Illegal or unreasonable demands
- (a) Violent acts, including demonstrations that are not limited to the use of physical force
- (c) Persistently forcing someone to make a transaction, such as purchasing an information magazine.
- (D) Making demands to the other party by falsely representing themselves as a victim group or other organization.
- (E) Other acts prohibited by the "Act on Prevention of Unjust Acts by Organized Crime Group Members"
- 3) If you inform the other party that you are a member of or have a relationship with an anti-social force.
Neither the Company nor the Customer shall be liable for any damages incurred by the other party as a result of the termination of this Agreement pursuant to the preceding paragraph.
Article 14 (Governing Law and Jurisdiction)
This Agreement shall be governed by the laws of Japan, and any disputes arising in connection with this Agreement shall be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
